The bit from the Childrens Act 1989 that says that unmarried mothers automatically have Parental Responsibility for their children?

If dd2 had been born 3 days later (1 december 2003), ex would have 50 % right to her, and I would have a court battle to prove what a shit father he is, eg pulling the children out of school, hitting them with sticks and many other things.

It's the Children Act (not children's!). This is the section (Section 2):

(a) the mother shall have parental responsibility for the child;
(b) the father shall not have parental responsibility for the child, unless he acquires it in accordance with the

This does NOT mean that a Court battle won't ensure. He can apply to bring an application for contact and/or PR, and the Court would almost certainly give him permission to apply. Not saying he'd be successful in the application, just that he'd be allowed to go to Court to make it.
