Landlord making a claim

So I moved out my last home as the landlady was moving back until it
I was only there 6 months
Anyway I accidentally dropped my hair dryer and made a burn on the carpet. When the inspection came I disclosed what I did and obviously said I would repair
I moved out 5th the inspection was done 6th and heard nothing so I called Friday 14th to be told I need to wait until she's had her quotes
I called Monday as I said it's been 12 days and I would like to know how long it's going to be
It's now Wednesday and nothing
The letting agency said i can call the dps but surely they should still e trying to sort ?
Any advice as this has never happened to me before

It will be interesting to see the quote to see IF the landlady is trying to make me pay for the whole thing or not

I'm not replacing someone's dirty old carpets when I've damaged an index size
As I've already said I've got quotes for £20?!

And Nessie the company I spoke to yesterday said it's approx £160 for a carpet for that size room replacement so no where near £275

How would you repair a carpet with a burn it it? I would assume it would need a total replacement.

No that's not true, I spoke to 3 different companies that can repair a burn. The one who said £20 said it's an easy job. One said £50 and a third said £95. They cut it out and use another carpet and bond it together apparently 😕

In that case get a written (or email) quote for a repair and offer that amount as a repair. Upload this against the dispute online and let the TDS decide. Good luck!

Good advice !
I'll do that. I'm happy to pay for the damage but in this industry you do have to shop around to get the best deal
Obviously she hasn't as she doesn't feel she needs to
Well I like things to be fair
She shouldn't be getting gain or betterment just to fix what I've damaged

The company I spoke to last night are happy to email me a quote so the price I'm willing to pay is more than the minimum quote so if she doesn't accept that then least that's what the deposit protection people are there for - they've been great actually x

A repair will look terrible. I think the ll is entitled to an amount towards a replacement, based on the age of the carpet and it's expected life (the calculation the deposit scheme will apply).

I was there just over 5 months
I'm clean and tidy and I scrubbed her dirty house and I didn't make them dirty
They were dirty before I moved in because she was a dirty person you could tell from her house
but if you want to believe that I made them dirty and that makes you feel better then you do that
You sound like a really nice person who has a lot going for them
Thank you to the other pp who have given me some good useful advice advice, shame about the others

And it was the LL who moved out in March and is now coming back to her house as she was dumped by her boyfriend
That's how I know it's her that's the dirty person not tenant
I was the 1st tenant there

And yes a repair probably will look bad
But will go with the rest of the condition of the house

I doubt that you would get away with a repair.

I would get a few written quotes to replace that carpet (£160ish) and send them to her saying that is what you are willing to pay.

One company quoted me £160 for the whole room so no way I'm paying for the whole thing
we shall see what happens now as the disputes been raised and in their hands now.
I have the photos of her very poor dirty carpets and the inventory notes so now up to them.
I have the remainder of it coming back to me today so least I have that and can forget about the £220 until they have looked into it
Funny she didn't show me the quote so now in their hands x

tough on the landlord if it is damaged and a repair is not practical (as it isn't), that's one of the things you have to budget for when renting.

from the photos the carpets are in a state anyway, but even if they were immaculate and a year old the above still applies. Landlords have to deal with damage and can only claim for the loss of value of that bit. As I said, I had a tenant who decided to iron in the middle of an acrylic carpet. There's no real comeback.

so no way I'm paying for the whole thing - except you are the one who ruined the carpet?? Doesn't really matter the state it was in, you are the reason it is damaged.

If you broke my old nokia phone, should you not have to pay for a new one, just because it was old and on the way out anyway?

And it’s not one of those things you need to budget for. A LL budgets for wear and tear. Excessive damage comes from the tenants deposit.

landlord and tenant law does not work in the same way as other situations.

and you can't break old Nokias, they are indestructible... Grin

That’s exactly it.

A landlord can not claim “new for old”. It’s explained earlier in the thread.

I get that her original amount is excessive but to not replace a carpet you ruined is completely unfair and very cheap.

I am going to pay for the damage just not a brand new carpet !
She should worry more on the filth of her home and the other stains on her carpet. And of course it matters on the condition of it! It was awful!
If it was new I would be saying the same thing, I will pay for any damage caused. And there are companies that offer repair.
I've spoken to yet another one today just to be on the safe side. They were just not able to come to the area. So 4 companies says they can repair it as it's so small.
I'm a fair person so that's why I'm putting up a fight. If she wants to buy a new carpet fine, but I'm not paying for it in FULL because I l my damaged a small proportion

That carpet is filthy and looks really old. I hope you’re given a fairer settlement OP. Don’t know enough to advise you but my hazy memory from uni days was that some landlords seemed to automatically claim for repairs and it was often overturned by the deposit protection scheme. Landlords should expect wear and tear on their houses, just like every other home whether rented or owned.
