Claiming benefits for grandchild

I have been given legal guardianship of my grandchild until he turns 18. Mum still lives at home and has parental responsibility but I have more parental responsibility. Daughter currently receives benefits for my grandchild. She buys things and gives me money for things. It works fine as we are but my question is do I legally have to claim the money now or can she continue to do so? She still cares for and lives with
me and her child. Thanks

Just to add I have care because of issues with the father, not because of problems with my daughter's care of her child

I think you really need to ask your solicitor that, sorry. Sounds complicated and you don't want random people on the internet to give you bad advice.

Either of you can claim. Her as the mother or you as the guardian. However you are probably entitled to Guardians allowance and in order to receive it, you must be the one claiming child benefit, and consequently tax credits. So overall, you will receive more if you claim all benefits, providing you qualify for tax credits re income as obviously tax credits are means tested.
