In 1988 I purchased a property known as in South Yorkshire for cash It was an ex-British Coal House.
In November 1989 I mortgaged the said property with a local Building Society under an Endowment Policy scheme for 19 years.
In 1996 I was forced to vacate the property as I was held up at gunpoint (which I reported to the Police), I was inform later on that the man was arrested for armed robbery at a factory at the end of the street.
In 1996 someone set fire to the house. I was informed by the Police. No one has lived in the property since.
In 2011 the Building Society now Bank took me to court for repossession. The mortgage should have been completed in 2009. But because of the Banks Crash the company claimed they did not have an Endowment Policy for me and stated that I still need to pay off the principle sum. I negotiated with them and continued to pay a mortgage. As I could not get anyone to represent me legally. And I was instructed that The Bank could tie me up in Litigation for years. Which I could not afford.
The Local Authority for that area have been harassing me ever since. They contacted me about the property and said there had been illegal dumping of rubbish and that I needed to clear it up. I sent my son to the property. He was attacked racially.
The Local Authority have wrote to me saying that they have a charge against the property and that it is to be sold. The Bank has told me not to sell it for less than £40,000. I instructed The Local Authority of this and that The Bank has 1st Charge on the property. The Local Authority stipulates they have leaped frogged over the procedure and are entitled to sell the house. Despite there having been no court hearing for repossession other than that of the Bank which has now been discharged.
In fact, they have informed me that they have a buyer and that the house is already in transaction. Again, this has been done without it being taken to court or any legal proceedings.
They have stated that if they do not get the full amount they require (and they seem to be intent on selling to this buyer), they will pursue monies from me personally at a later date. I have contacted HM Land Registry to request how much The Local Authority had placed on the Title Deed as a charge. They said £243.78. When I telephoned The Local Authority to say I could pay this. They immediately said the amount had escalated to £2,750 since January of this year and if I manage to raise the money they would add additional sums.

I am being told I have no rights of Appeal. There has been no court hearing on this matter that I could attend and defend this case. I cannot find any solicitor or barrister who will act on my behalf (even if I could pay for it), as they have all stated they cannot go against the state.

We left this place over 22 years ago because of racism and I am still being persecuted.

The only thing I do know is that in recent years there has been a brand new private housing estate built over the road. But no help has been given to us in the old pit houses.

I'm struggling to understand your post or why it's dragged on for years - why didn't you sell the property in the mid 1990s when you left? Did you just abandon it?

I have no idea what you mean about lawyers and barristers not wanting to go against the state. Do you mean you have had legal counsel and been advised that the bank is acting legally?

I'm struggling to see anything other than paranoia and conspiracy theory in the tale told, so if you can clarify who you've consultanted and what you've been advised that would help. For example, it sounds like the endowment mortgage couldn't cover repayment of the capital - was this missold? Did the bank warn you of a shortfall in writing? Did you provide your contact details after you left the property?

Attempted to sell but when I tried found that a restriction had been placed on the property register so that I was not able to sell it easily. There was no court hearings. It was done according to the Registry directly to them without mine or the banks approval.

As for Barristers and Solicitors, they will not go against Local Authorities anymore since central government granted them the powers to do this. Have documentation to prove it.

But the emphasis of this warning is everyone should keep a check of their title deeds. Because I have never had a 2nd Loan or mortgage on that property but apparently there are 3 /4 entries on there now that I was not even aware of or told about.

Yes you are right it does span years. Because all this time I was still paying all the bills for the place. I did not check up on what was going on due to illness and family.

I am not the only one this has happened to on this street. Another person who used to live on the street explained that her husband died working down the pits. The house was the only thing he left her. She wanted to raise money by selling it to give her DD and family the deposit for their new home. She was so upset with what they did to her. They forced her to sell for less than £10,000 for a three bedroom property over three floors. The property was in good condition. Over the road the houses are selling for over £150,000. Whilst mine and others in the street are going for £50,000 if they are lucky. more usually like I have said they are now selling them for less than half or only 10% the market value.

And now the Local Authorities are saying its going to be done. taken out of my hands despite the Banks who have the only legitimate charge (only people I ever contracted with to place a charge on the property). Saying that I should only accept this if they sell it for £40,000.
