So if some completely inefficient company with non-existent customer service send you the wrong item....

.... and say that they will refund you for what you ordered and that you need to re-order and that they will pick up the things they sent you in error sometime within the next 2-7 days, is it illegal to keep what they have sent you in error ?

I am hugely pissed off that though it's their error they will not rectify their mistake and send me what they ordered. What I got in error is worth more than my original items. I have raging PMT and want to stick them on Ebay I am so fed up with them but am assuming that somewhere there's some law that would make it illegal for me to do that. Anyone know for sure ?

I think if they will collect within reasonable period then you can't take possession and sell them on ! Try here for info.

Thanks Lizs, I shall leave them sitting in the the box in the corner and see when they come and collect them. I gave the guy on the phone such a mouthful that I think he might not dare ! It really annoys me though, why on earth can't they just send a courier with the original order and pick up their mistake at the same time for goodness sake ? I am being very hormonal aren't I ?!

well i dont know if it counts... but im sure ive herd somewhere that anything delivered to your home [by post] is yours regardless.... and it is the compnaies fault for sending it to you wrong.

I think if i were you i would 'loose' (hide ) and not give it to them straight back...

tell them it was accidently lost and to sue you for it! Im sure it wont be worth the hassel to them.... and THEN sell it on ebay!

Probably if a business had its own delivery vans then they would collect it easily but courier companies are sometimes a bit difficult to work with. I know that when I have asked them to do specific things like collect an item whilst delivering another they haven't had a clue, specially as the package would need a new waybill.

My friend has had similar fun to you, times about a million, with kiddicare who never seem to send the right thing or it arrives broken or with major bits missing. Then they start faffing around when you ask them to collect said item only for them to replace it with the wrong colour/size etc that needs picking up again.

Isn't the law tell tham and they have 30 days and its yours, don't tell them and they have 6 months to collect before its yours.

I would get a refund and let them come a calling
