Anyone gone bankrupt? About to book court date but have co-habiting house question!

Yup, am aiming to go bankrupt before I start back at work. It's (only) for about £17k but it seems like it's worth the risk; I've been on a payment plan with the CCCS for about 2 years which has screwed my credit rating anyway. I can either carry on like I am for the next 10 years with rubbish credit struggling with a baby or go bankrupt and just have rubbish credit for 6 years.

I don't at the moment really have any assets, my car's not valuable enough for them to take and my name isn't on my boyfriend's mortgage. The house is the only thing that worries me though, if they think I have a "beneficial interest" in the house it could get messy. I've been here 3 years but that's not totally proveable (ie I could probably say 2 and get away with it) and I've never paid half the mortgage in a formal way, although whilst I was working I did pay money to my boyfriend which was about that amount.

Has anyone been in a similar boat? Any advice?

is an IVA preferable?

don;t know really

I;d look at moneysavingexpert.com or motleyfool.com

or go to the CAB

That should be motleyfool.co.uk, .com is the US site. If you post on Dealing With Debt the resident bankruptcy expert Sonic will know the answer, I don't think you'll be considered to have any equity in your dp's house but best to check with someone who knows.

Cheers, will check out MSE, the forums over there are quite good if I remember rightly...

I think that you would only have equity in your boyfriends house if he would not have been able to pay the mortgage without your contribution.
