I was allowed to claim as single when my husband and I seperated but shared the same house. This was only allowed in the shirt term it was made very clear to me when I made the claim.
They expected us to be living apart in the next few months abd they did check.

What aboyt this babies father? He has ginancial responsibility.

Are you and your husband a couple?

If you are a couple you are not single.

Answer the question are you in a relationship of not? Why would you stay after 2years if your not? I think your friend is completely right your claim is not right.

How is it confusing? You must know whether you are in a relationship or not? You are married and live together which does suggest you are a couple. Do you go out together? Sleep together? Go on dates? Not date other people? It's sounds to me like you are in a relationship.

If you are a couple, in a relationship together, then it matters not that your finances are separate. For the purposes of Tax Credits you are a couple so you cannot claim as a single person. Simple.

The only time you can claim as a single person whilst still married and living with your husband is if you are not actually together as a couple anymore, and you are seeking alternative accommodation.

For example; when I split up with my Ex it took a couple of months to sort out a new place to live. I slept on the sofa and claimed as a single person while I got organised.

Perhaps when you phoned up before, and told them you have separate everything they misunderstood and thought you meant you were 'separated'.
