Child maintenance

KeepYourFriendsClose · 12/05/2018 20:55

Is there a simple way to know what child maintenance I'm entitled to?
Dad's income of £28k before deductions and has 2 children elsewhere but she doesn't want his money. I care for the baby entirely and live only with the baby. His surname is on birth certificate and no doubt the baby is his. I'm wondering how much per month/week I should of been getting and if there's an easy way to work it out? TIA 😘

Even if he doesn't pay his other children (assuming they are still considered children), they will take them into account because he SHOULD pay for them too, even if mum isn't bothered.

I’m not sure if that’s true @swingofthings I used to work for the CSA and a Relevant other Child was only counted when they lived with the NRP. (A ROC is when a deduction can be made in income eg 15% for 1 child) As far as I know, it hasn’t changed with the CMS.

It is up to each individual mum if they want to claim.

@MismatchedStripySocks, my understanding is that maintenance is worked on income and takes deductions into account (and indeed whether children are living in the household), but then, the maintenance is to be divided between ALL the children not living with nrp.

What I was trying to say is that they would take into account that he is 2 other children that he is supposed to pay for. It might be that he can then pick to give all the money to OP, but he might decide to keep the rest and put in a saving account for his other two kids for instance.

Its coming up at £260 it only asked if he was living with other kids - no. I wonder if that's right then. I have a benefits call with CAB soon so might ask them too. I just would like a figure so I can ask him to please pay rather than going in guns blazing with CSA or whatever the governing body's called

OP as far as I am aware the basic formula is:- gross income less % for any children living with him = income to be used to calculate maintenance. Weekly income x relevant % for number of children he pays maintenance for whether via a private arrangement with the mother or through CMS, apportioned to each mum in basis of number of children e.g. if liability was £60 A week for 3 kids, if you have 1 child you'd get £20 and other mum £40 If she has 2 kids. CMS Would contact the other children's mother to determine if he pays maintenance for them. If he doesnt pay for them I don't think he can have them included in the calculation of your maintenance. Call child maintenance options they should be able to help you. Google them and im sure you'll find a number.
