So... i have a problem. I am not british so sorry for my mistakes. Ive moved out two months ago from an apartment to a house. I know for sure that i contact council tax and they told me that they would send me a new bill to my apartment for CT. ive waited for that bill and ive opened it and went straight away to pay it.The bill, which ive paid half of it its on my owners name. i know its my mistake that i didnt look twice on the bill. Meanwhile, a few days ago, from the old apartment ive received a letter for my apartment that i need to pay CT bill followed by a SUMMONS for non payment. The thing is that there are two bills the summons one and the owner one. I paid half of my owners one and i knew that everything is perfect. As i received from an old neighbour just a few days ago the letter for the apartment to pay the CT followed on my new adress by the summation i just stoned. I couldnt find the bill that i1ve paid when i spoked with an agent and later i realised that ive paid my landlords one but it was too late to call again. I spoked with my landlord and he said to me that probably my old landlord from the apartment forgot to call to them to say that i dont live there anymore as the property could be empty right now and as long as i paid, here on the house, half of bill even if its on his own name i shouldt have any problem cause they will investigate and cancell it . My mind right now is spinning cause i cant chill out.... The phone agent told me to call again monday or to go to CT tuesday to show them the proof. I have the receipe and my bank statement that shows that i`ve paid half of amound.

Give me ideas ,.... what i should do...? :(

Do you have receipt that you have paid and the letter?

Send them an email over the weekend op. Attach a photograph with copy of receipt and say it was paid against the wrong account in error and ask for it to be transferred to your own account. Then clarify the date that you left your old address and the date that your tenancy ended. Then relax. Call them on Tuesday and ask them to check your email and ask for a revised balance following the issue of the court summons. If there is nothing to pay once these things have been done ask that they withdraw the summons and court costs owing to it being issued in error. Good luck op, hopefully once these things have been done it will take care of all or most of the balance. If there is anything owing after, ask to pay it off in an instalment plan that you can afford.

yes, i have both. i can get and a bank statement and i have the receit paid for 5 months. its almost 600 pounds

This all sounds very wrong. Why was the bill under the name of your landlord? Has it always been like that and therefore you never paid for CT or was it only after you left? Why would you pay half?

Either there was an arrangement by which your rental included CT paid by your LL. This arrangement would normally be dodgy as most likely asked by the LL to avoid paying tax.

The other possibility is that you were paying your CT but moved before the end of your AST. If you called the Council to say you were moving, they would automatically have bill the LL for the CT bill from that date on. However, if subsequently your LL showed that you left the property without their agreement before the end of your AST, they could have made a case that you were still responsible for the CT for that period.

You need to go there asap indeed and sort it out.

I paid hald of the bill because i have a 6months contract. The letter from the apartment it was redacted right on the day that ive moved out. I know that ive called that i would move out . Meanwhile i found a letter from my agency that shows that they will contcat the CT , water etc that we would move to the new adress because i was still with the same agency.

Go and speak to your council and take them your tenancy agreement to show when you moved out of the property.

The old landlord isn’t responsible for telling council tax if your moving out, so you may still have to pay Simmons

But you can ask if they will put the two bills together and spread the cost over the remaining 11 months till next March

This is so confusing... What I make out to be:
You moved in a flat on a 6 months contract. You were liable to pay CT from day 1, but for some reason, you didn't pay anything during this time?

You get to the end of the 6 months, you informed CT that you were moving. They sent a form to inform on what the payment is due but that was addressed to your LL, and you paid half of this.

The issue is that CT is due (I believe everywhere) from April to March. So if you moved out 2 months ago, that would have been beginning of March, so you moved in the flat early October. This would mean that the previous tenants, or your LL would have paid for the period of April to October, you would have had to pay for October to March and your LL paid March to April.

If you didn't pay your CT bill for 6 months, and then only paid 1/2 of the March bill, then it's no surprise they have sent you a summon.

If you did pay your CT monthly for the 6 months you were there, why would you think you had to pay any more for the flat after you moved out? Or did you think you needed to only pay the last month?

If the council tax bill is not in your name, then you’re not liable

To have a court summons in your name would mean that you’re liable
