anyone know anything about probate

My dad died three weeks ago and we have been informed by his solicitor that his will does not need to go to probate. I don't understand as my FIL died 3 weeks before that and his will does .
Its all very confusing .
We have not even been shown a copy of the will so are not completely sure of all his wishes.
I just want everything to be done as he wished, I miss him so much .He was a very fair man and I would like to think that things are done correctly.

My Fil 's will was very straight forward he just left everything to my MIL .
No-one is contesting it nor does he have any outstanding debts.
As far as I know My dads will is pretty simple aswell ,everything is shared between the children and grandchlidren ( mum died 12yrs ago)

The need for a grant of probate can depend on the size of the estate and whether there is any property in the estate (what the americans would call real estate). If you are happy to post more info here I will try to help. If you would prefer to keep matters more private, please feel free to CAT me

All my dad had was 2 bank acc's

  1. chq/ credit card ( no outstanding balance)
  2. ISA
  3. house and contents.
He was in hospital for 7/8 wks before he died so my sisters and I had power of attorney to pay all his bills, so there was nothing left to pay except solicitor and funeral costs. Solicitor has seemly paid for the funeral. there is a distinct lack of info from himand my sisters never seem to ask much!!

I would go back to the solicitor as I seem to remember that the executors would need a grant of probate to either sell the house or to transfer it into the names of the beneficiaries.

Condolences to you and your family. What a sad time for you all. This is a link to an official leaflet regarding applying for probate, which should give you some idea of financial limits. I can't understand why your dad's estate doesn't involve probate if he owned a house.

I am a probate solicitor please CAT me if I can help.............no charge of course.

Depending on the amount in the bank accounts you may need a grant of probate to deal with them although the solicitor may have asked the bank to pay the funeral director direct so the amount may now fall under the limit.

Did he own his house ? If so and it was in his sole name you will need a grant of probate to make good legal title to the house to sell or transfer it.
