PLEASE someone help me - reclaiming bank charges NATWEST.....

pucca · 30/04/2007 10:44

Natwest have had £1890 in charges off me over the last 4 years. I did write the first letter a few months ago and got the standard "our charges are fair" reply, so sent the 2nd letter stating if i didn't hear from them i would file a claim with the small claims court.

I wrote to them (the template letter) and included highlighted copied bank statements, i posted it recorded delivery (but daft dh has lost the slip) about 4 weeks ago and have heard nothing.

I did send to the customer relations dept as this is who to complain to (not sure if this is correct) but what should i do now? i haven't heard anything

Is it worth phoning the 0845 number, will they know anything about it?

Please help me, i could really do with this money back.

TIA

dp called the number, and they told him to send off the highlighted bank statements and they are supposed to be processing it.

singingmum · 30/04/2007 10:47

Pucca have you heard about people who have tried to get charges back and have been told to clear and close their account.Apparently my mum was telling me this has been happening.Am sceptical of wether it's worth the risk. Will be watching this issue carefully

pucca · 30/04/2007 10:49

Thanks Kelly1978...If i give them a deadline they are supposed to stick to it, is that right?

This letter i sent was the 2nd letter but included the bank statements in with it too. Just not sure what to do now, could kill my dh for losing the recorded del slip too as i can't remember the actualy date sent, it was about 4 weeks ago though.

SM...No, not heard that, everything i have read etc is that they pay out eventually but they can ask you to clear your account afterwards.

Scary!

Ok have just phoned natwest and they have recieved it, but they say they have 8 weeks to reply, i thought it was 28 days

apparently some banks have been closing accounts, but it is supposed to be rare. I reckon they are stalling because it is a fair sum to pay out, hopefully you will get there in the end. If not, file it with small claims, then recover your costs as well. It is very easy to do. MAke sure you note that you spoke to them today and that they confirmed receiving it. Good luck!

They DO only have 14 days after a letter before action which is presumably what you have sent them.

They are forbidden by the banking ombudsman from closing accounts in revenge for claiming back charges.

Might be time to issue proceedings

pucca · 30/04/2007 13:20

Yes i did state 14 days,so what do you think i should do? The woman i spoke to at Natwest said, when i questioned the time scale... the financial ombudsman says we have 8 weeks to respond and that my claim was being dealt with by the validation team.

It has been 4 weeks and i only really rang to see if the letter etc had been recieved as i havent even had a acknowledgement so didnt have a clue as to what was going on.

Thanks everyone btw for helping me, i am hopeless at things like this

I have still waiting for my bank statements after writing to Natwest on 28 Feb. They have sent me a letter acknowledging that letter. I have phoned them to say that I have still not received bank statements and they said that they have backlog etc etc. Also have been told though that they will not be closing accounts down.

pucca · 30/04/2007 14:35

Lolly...I just phoned them up and they ordered the statements over the phone, they came really quickly.

To be fair they prob have loads of claims, i should have done it yonks ago when it all first came about, but couldn't be bothered then.

I got my statements, wrote and asked nicely for the money back... no reply. Sent off the LBA last week, recorded delivery. They've got till Thursday then I'm going to phone up and see what they say... then I'm going to file if I have to.
I reckon they owe me nearly £5K and that's without interest. Grr. Want it back RIGHT NOW.

Lolly68 · 02/05/2007 10:36

Pucca - I have spoken to them twice over the phone in the past 3 weeks and have still not received them. Wot do you think I should do? Also I think they owe me about £5k so am anxious to get this back now.

pucca · 02/05/2007 10:38

Lolly...See i didn't say i wanted them for claiming charges

I said i had lost all my statements in house move so would like copies of them, i had them within a week, they just took payment straight out of my account..dead simple.

Try that one, just ring up, don't mention claiming charges, just say what i said and that should do it, i think they are trying to delay people in claiming it back.

Let me know how you get on.

OP posts:
Lolly68 · 02/05/2007 10:41

Oh ok... will try that then. But I think they may have been on record in ordering them before. I'm worried the law is going to change and I wont be able to claim anything back.

pucca · 02/05/2007 10:45

Lolly...The only other thing to do is actually go into your branch, they should do it there and then for you, in fact they may even just print off the charges and not the whole thing, that is the only way to get them literally today, maybe worth a shot.

I know what you mean about wanting it back and quick, especially with that high profile case being adjourned, the trainee lawyer who natwest even offered him double back! but he is taking them to court big time as he said he didnt agree that even though they offered him double money, they were still stating their charges are fair!

Not sure when that will be now, all i know is it was postponed.

OP posts:
Lolly68 · 02/05/2007 12:29

Do you think I could go into any Natwest? My branch is over in Holborn and I'm at Fenchurch Street.

pucca · 02/05/2007 13:03

Yes go into any, they all the same and they will be able to access your account.

Lolly68 · 02/05/2007 13:05

Will try this lunch time then

Kelly1978 · 02/05/2007 19:43

we're still waiting too, they've received our statements a month ago now, and we've heard nothing. Don't forget to send everything off recorded delivery.

fussymummy · 02/05/2007 20:05

I went into Halifax today about charges.
They charge £30 (don't know how they can justify it?)for each transaction overdrawn, upto 3 per day!!!!
I forgot to transfer cash into my spending account a few months ago and now they've charged £210!!!!
I got told to send a letter to their head office and should receive it back.
Will tell them that if i don't get it back then i'll close all my accounts and kids accounts that i have with them!!!

Lolly68 · 04/05/2007 09:52

Pucca - I finally received statements. Have added up charges over past 6 years and they owe me £7739.24!! Now all I have to do is send statements back with letter dont I? Wish me luck!

Natwest Business department nearly destroyed my business when we hit harsh times from 2006-2010. The amount of charges they put on the account were so huge, it is only dawned on me how much we paid out to Natwest, thousands.

The business is rebuilt and we bank with HSBC who we have never had an issue with.

As for Natwest, I put in a claim last week. We have every single bank statement kept in storage due to company accounts. So if they get pissy and ask for every statement from all that time ago, then we have them, every single statement.

They nearly destroyed my business on purpose, they were a part of the stress that caused me to suffer a brain aneurysm in 2012 and they deserve a huge fine for what they did to my business.

I am anticipating with interest added on over the years, to receive including damages in the region of £10,000. If they come back with a stupid offer, then I will sue them, it is that simple.
