HELP......Is the car behind ALWAYS at fault in a shunt.....?

...even when the driver of the car in front had had his leg out of the window seconds beforehand .

Two witnesses are willing to vouch that the driver stopped for no reason in the middle of the junction, though were on the wrong side of the street to see the leg incident. Also, car insurance renewal is due next week, am I still able to move insurers for a cheaper premium (realise that I'll have to declare this to them).

driver in front should have checked his mirrors before suddenly stopping, although i suppose those behind should be keeing proper distance. tbh dunno how these things are decided. weird about the leg!

the driver behind should be keeping sufficient distance to stop in time. So yes, always responsible.

even when the person in front cuts up the rear car and does an emergcncy stop right in front of them for no reason at all...

as happend to my friend

if you hit them from behind its your fault for not leaving enough stopping distance

Although i did win my case, but it was hard and took ages.

I was driving down a country road when a car reversed out of a farm gate onto the road and hit me. I think it helped that the witness was a off duty policeman. But it still took nearly a year to sort out.

Hello!

Following on from yesterday, we have had the Mum of the bloke whose car dh shunted yesterday evening call twice today and she's calling back later this evening apparently (you would have thought that if he's old enough to drive, he's old enough to deal with this but no...). Dh gave his name, address & telephone number over at the time and we really don't want to keep having to deal with them direct so is it OK to say that we will only deal with their insurer from now on? I think they want us to give them our policy details but wouldn't it be better that we supply them directly to their insurer.

if the person behind shunts then they shunted because they were too close tocar in front, apparently.

Leave it with your insurers. Be sure to mention they were driving very dangerously. In fact, the police should have been notified.

Dh ahd a silly cow phoning him after a shunt (when he wasn't even in the county- set up) and he refused to deal except with the insurers, that is not only acceptable but correct procedure. You shouldn't be discussing.

Erm, he did have insurance did he? Just the only times I have heard of this the driver either didnt have a licence / insurance / or was just lying, and trying to convince otehr sriver they were willing to do a 'deal'.

They are entitled to ask for your insurer's name & your policy number as well as your contact details (in fact these should have been gven at the scene, or as soon as possible after), but once you've given those, I'd tell them to deal with your insurers.

DH got claimed against even though another car doing about 50mph hit DH who was stationary in a traffic jam. Unfortunately driver who shunted him into the car in front screeched off down the hard shoulder so we had to pay for our car & one he was shunted into. [grr] Although there were witnesses no one got the first guy's reg no or the police would have pursued him. Probably stolen or had no insurance & that's why they legged it. It's a bugger when you feel hard done to.
