neighbour just died - what happens with a party wall agreement?

Hi our neighbour has just died and we were just starting all the paperwork to get a partywall agreement for a loft conversion. Anyone know who we should deal with now? the children or the executor (I think it's the bank due to something the son said last week?)

And should we push for them to allow a full survey in case new buyers come back and say all probs with the house (hasn't been touched for about 40 years....)are due to our building work or would this not be possible?

you send the notices to the house itself

bear in moind that if they don't respond within 10 days then it falls into dispute and you are obliged to appoint a party wall surveyor on their behalf at your own expenses so it is wise to wait and speak to them first to avoid the hassle and ensure they are in agreement with your intentions

I think I would want to bury my parent and would expect a modicum of dignity and respect thrown in from the neighbours.

A party wall would not be high on my list of priorities TBH.

i dont know who to talk to, but agree with giing the children space to grieve for their deceased parent

sorry didn't mean he had JUST died - it about a month ago. the children are coming most weekends to clear out the house and have put it on the market so I think they are in the 'sorting out' stage - or else I wouldn't dream of approaching them.

I just wondered if anyone knew the answer as I'm not sure they will know themselves and didn't want them to feel like there's something else to sort out.
