5k Debt

My partner has just admitted to being in 5k in debt. It was not spent on the house or towards household bills just purely on himself and has acquired 3 ccj?s on joint Water and gas bills (the only bills he pays out of his account) so that means I now have 3 ccj?s on my file. I have agreed to get 5k on the mortgage but would like something drawing up by a solicitor to say if we split up he will have to pay that 5k back to me, does this sound fair?

Is there anything stopping him doing the same thing again?
Not sure about the mortgage side of it.

I don't think you should agree to remortgage to clear his debts. They're his sole legal responsibility if they're in his name, so if you split up, they're nothing to do with you.

You could, if you have to, do a trust deed reflecting the fact that you will have a larger percentage of the equity if you split, but that'll cost a few hundred pounds in addition to the remortgage fees. I really wouldn't recommend that route (I'm a family lawyer, btw).

We got an equity release loan secured on the house to help dh clear some debt. 8 months on, he is in debt again. We have separate finances so I didn't really know what he was like with money, but I wouldn't do it again to bail him out and we're married with children, so have a pretty high level of commitment.
