CTC overpayment

I have a new partner who was in a relationship with someone else when the claim was made. The other guy had a daughter who they claimed for and there was an over payment. Now the money for the over payment is being taken from my childrens CTC. The child didn't even belong to my partner. Now we are paying back HMRC for someone elses child. What do we do? The claim was from 2008-2009.

If it was a joint claim, your partner is only liable to pay half of the repayment.. Has she explained the situation to HMRC?
