affect of benefits due to inheritance?

PLEASEHELPURGENT

the position is i am a occupany lived in own house over 40 years currently on benefitt due to serious health matters ex carer.
Due to probate probable will attain a 3rd of house and inherit monies; i havetried to find out through solicitor how it will affect my benefit no answer from solicitor, can anyone please help me. i am si in shock it is avvecting my health thank me. (apologies if typing bad i ahve slight dyslexai)

It depends what benefits you are receiving. generally speaking any means tested benefits such as Housing benefit, ESA ( income related) etc will be affected by anything over £16k.
With tax credits you have to declare any interest on capital over £300 interest.
What are you claiming at the moment?
Disability benefits such as DLA or Pip are non means tested and won't be affected by inheritance.

It would be better to contact a CAB for advice, a solicitor is unlikely to be a benefits specialist. You might be able to retain ESA if it is contributions based rather than income based. And PIP/DLA as mentioned above. Which benefits are you claiming right now and will you be able to live in the inherited house? The value of the house won't count if you're living in it but if you sell it or rent it out then the value will count.

It should tell you on an ESA award letter if it is contributions based or income based.

Perhaps you need to ring esa then and find out which one you are receiving. Sometimes people get both income related and contributions based. If that is the case for you then I imagine the income related part would stop .

if you inherit a large sum of money and a property then surely you'll no longer be eligible for (or need) benefits?

Sorry I have no idea what you mean with the £10 ?
Peaceout - If op is on contributions based esa it is non means tested so even with a large inheritance she would still get it. Likewise with pip or dla or attendance allowance.

And once inheritance money or assets drop below the threshold (16k??) then I think you can claim benefits again

Yes above £6k and below £16k I think they taper benefits.

Are you the executer? Is that is what is worrying you ? If so if you feel you can't handle it because of your depression you can appoint a solicitor to do the job for you. it does cost quite a bit. The probate forms are stressful.

I have just done probate and they are not too bad really. You could also ask on legal matters ( on here under other stuff) if you want help with probate forms op. Smile
