MEDICAL NEGLIGENCE....... long, sorry!

most of yu know my story but if you dont here goes:

ds was born 22m ago, at 38w i measured 42w. he was back to back and engaged/disengaged 3times. im 5'1" and a size 8 with v tiny hips.i asked for a caesarian but was told that the hosp didnt do elective cs, didnt see my consultant once despite being in and out of hospital throughout my pg. i had 3 failed inductions, my waters broken and they were green! after 3 days of labour i had an crash cs. i then contracted GBS in my uterus, my placenta was in bits and noone checked it fr signs of infection.

since the cs i have been in agony. ive had headaches, and urine infections all the time. stomach aches, sickness and dizziness. all this resulted in severe PND. ive also had 3 confirmed mc and last month an ep. after the operation to remove the ep and tube it was necessary to open me up properly coz i was bleeding internally and had lost a lot of blood. for this they used my cs scar, and in cutting caught my bladder. the reason for this is it was put back too low down. my remaining tube is covered in adhesions along with my womb and ive been told that its unlikely that we will conceive again naturally.

do i have a case for medical negligence, how do i word the initial letter and how do i go about it?

Lissie if they think somethingin your notes will cause distress they do not have to disclose them, I hope you find a good solicitor to advise you on this

Lissielou - we did win our case against the health authority for my birth experience that went completely wrong. To get the ball rolling, ie. to see a solicitor, was really easy. After that, the solicitor did all of the hard work, paperwork etc and we had meetings periodically, and they took a statement from us. After that, it took some time for the negligence to be proved. But it is perfectly possible.

So, once the initial consultation is done, please be reassured that the solicitor does all of the hard work, not you...good luck.

Lissie, when your dh posted on here I remember thinking this sounds like a case of medical negligence.

I'm sure someone on MN is a solicitor who specialises in this area - or possibly their dp. For the life of me I can't remember who, but hopefully they will get to see this thread.

Only just seen this, so for you.

Just want to say be careful on the no win no fee type solicitor. I went this style with one for an accident in Mcdonalds, and as I had legal cover with my house insurnace we had to use that. If we didn't have this cover, we would have had to sign an insurance type cover (which we wouldn't have to pay)to cover the solicitors costs.

And as others say, make sure you get your notes before you send any letter. I know someone who sent a letter then asked for notes, and notes were lost!!

yes some of friends notes (same as earlier posts) - the ones that completely exonerated her and would have won her the case never turned up. Plus another set from her original surgery disappeared when the consultant retired......

I would ask for your notes asap - if anything it will speed up the process of getting them........

Will never know if they were not handed over deliberately but there are time deadlines to stuff once a claim is being persued and it can take a very long time!

think my friend was dealing with 3 or 4 different PCTs which made it more complicated.

Good luck, I think some of what happened to you is just unfortunate/not negligent but some of it def does sound worth pursuing. Sadly medics can often close ranks. Perhaps you also need to think thru what you want to achieve at the end of it - how much does private IVF and private adoption cost? Nothing can compensate for what you've been through but settling out of court could be less stressful? Try and remember that childbirth is risky and uncertain that's why the deathrate was really quite high until recent times.

I do wish you the very best of getting some financial compensation so at the very least you can complete your planned family.

Don't know if it's of any use but know that a firm called Irwin Mitchell who last year merged with Alexander Harris, a legal firm who specialised in clinical & medical negligence, including last year's Northwick Park drug trials. They have an enquiry line that might be worth trying 0870 1500100.

i know of alexander harris...they are the absolute best for this sort of thing, IMO

For info, you will have to google "Irwin Mitchell" cos AH doesn't exist in its own right anymore. However the AH team now work there so you'd be in good hands.

spoke to a solicitor who seems quite confident. theyve written a letter for us to send to hosp complaining.

I'm sorry to hear of the terrible time you've had,Lissielou.I had to use Irwin Mitchell after a car accident a few years back & they were absolutelty crap.Nothing was done unless I chased them up,the case was passed between different members of staff,so no one seemed to know what the other person had done.My case was in limbo for weeks because someone left & left & the new member of staff didn't bother to look in the file.Honestly,I could of done better myself.
