If my husband inherites an estate not through will, but law does it become 1/2 mine also? We are having a few tax issues. Thanks.

No I think it remains his

Unless you divorce and then it is all up for grabs if you know what I mean

Bugger. He is selling it all off and giving it away and I need to stop him

if he inherits it alone it goes into his name and would be his only. So you couldn't put a block on him selling parts.

The property would be 1/2 yours if you were left the property jointly.

He didn't inherite through a will, there was no will so it was passed onto the first person if that makes sense. I presumed as we are married it would have been passed onto us as a married couple.

so he is the nearest relative to the deceased person? My understanding is it passes to him only.

TaxIssues · 02/03/2007 15:05

Yes, he was nearest relative. Such a mess

if it's an "estate" that he's inherited (house/houses etc) you might want to point out capital gains tax implications to him that occur if/when he sells...

..though I think this pro ratas dependant on how long you've had the 'investment'........

You, as his wife, will have a claim on anythign that becomes part of his estate, but you are not a beneficiary as such at this stage. Is he the executor?
