mum was a witness to the signing of a will, the man has died. the deceased solicitor has phoned mum and asked her to go in to swear on a bible and do an affidavit?

whats it all about?

Perhaps the family or someone is contesting the will or saying it wasn't properly signed.

Mumpbump · 20/02/2007 12:23

Don't know, but would guess the will might be being contested. I imagine that all she will be asked to confirm is that she saw the man sign the will without being coerced or unduly influenced in anyway. I'm sure someone more knowledgeable about this sort of thing will be along...

just legal proof that she did witness it as she says she did .. obviously someone has raised an issue over it

clarinsgirl · 20/02/2007 12:24

I know that Executors have to swear an affidavit - is she an Executor?

brandy7 · 20/02/2007 12:43

shes not an executor just a witness.

shes signed so many over the years from doing all the old bids haircuts!

she thought it might be because the old man has left all his money to a dogs home.apparently thats what a lot of them do to stop the family arguing!

thats ok then, she was worried because the solicitor said she would have to cross the road to theother solicitors and swear on the bible, bless her

For a will to be valid the witnesses have to see the testator sign and he/she has to see them sign. They'll be wanting her either to confirm that that's what happened (in which case the will is valid unless there's something else wrong with it) or say that it didn't (in which case the will won't be valid).
