Can anyone give me a good definition.
Dh was dismissed a while back, for no apparent reason, coz he served less than a year he could not go for unfair dismissal.
The employers will not leave him alone, what can he do.

What do you mean, they wont leave him alone? In what respect?

chocolatekimmy · 15/02/2007 21:29

If he has already been dismissed then he can't do anything unless it was for any of the discrimination headings such as sex/race/disability/religious belief or sexual orientation/age etc as they don't have the one year service qualifying criteria to take it to a tribunal.

What do you mean they wont' leave him alone, when did he finish with them

crispyduck · 15/02/2007 21:32

They are accusing him of theft, cant go into detail VVV but they are making sure that contact is still left open iyswim.
They are trying to slur his credibility.
Oh and the theft allegation was made after he was dismissed.

Dont' really understand, not enough information.

How are they trying to slur his character - would suggest he talks to CAB or a solicitor.

VeniVidiVickiQV · 15/02/2007 21:35

Contact the CAB.

Without having formally disciplined him wrt to this theft, they cannot use it in connection with references etc.

Need more info, but, basically, he needs to go to the CAB pretty swiftly.

crispyduck · 15/02/2007 21:37

Sorry I seem so vague, really finding this difficult.

actually depending upon how he was dismissed will determine if he can take them to a tribunal. please look at teh acas website as there are very strict rules now in place to determine the dismissal process

jampot · 15/02/2007 21:40

i started employment tribunal proceedings against my ex employer because of teh way in which he made me redundant. we did settle out of court but the rules are there to be kept

jampot · 15/02/2007 21:40

plus he was a real tosser

crispyduck · 15/02/2007 21:41

CAB not much help, I am afraid.

OP posts:
VeniVidiVickiQV · 15/02/2007 21:53

crispyduck · 15/02/2007 21:55
