Mother in law offered voluntary redundancy will this affect ESA she has severe depression.

My mother in law suffers from severe depression and has been out of work for over a year 'on the sick' and recieved employment and support allowance.

Will taking this voluntary redundancy affects her ESA? What will she be able to claim benefits wise?

She cannot work, she's not in a fit state too at all.

Could she ask for a settlement agreement? Look them up on Acas. The agreement can be worded so it won't affect benefits.

If she is on income based ESA then any money has to be declared I don't know what Silvertrap means by wording on a settlement but DWP rules are very clear when it comes to savings and means tested benefits. 6k does not count £16k means no benefits with a reduction in pro for anything in between

The problem is that until she knows how much her package is she wont know how it will affect her benefits so she needs that information before she makes the choice

What she cant do is decide to spend her redundancy and reduce her savings on purpose to maximise income related benefits there are some things she would be allowed to spend it on and some things she cant

She needs to find out her package and then put everything into a benefits calculator if she is over 50 then Age UK have a very good one
