I haven't been paid by ex-employer... small claims court??

Any advice gratefully received. I did some freelance work for a few months up to Christmas. I resigned from the "job" mainly because the woman who contracted me was a nutter!. I discovered that she had a terrible reputation with the company and was known to be a difficult woman. I therefore decided to just get out!. I was supposed to give 1 months notice which I was prepared to do but under the circumstances I thought it best that I leave within a week. She agreed to this, although rather begrudgingly. I didn't leave her short staffed BTW as they had entered a quiet period anyway.

However she has not paid my final invoice. Is she entitled to withhold payment because I didn't work the full month? I sent a chase letter and an email asking for payment within 7 days, both have been ignored. What do you think? is it worth going through small claims? Some of the money I'm owed is expenses i.e. petrol/parking that she agreed to pay.

Thought I would also add that they never had any complaints with the work that I did.

I'd fill out a claim form (N1) from your local county court and send her a copy. Tell her if she doesn't cough up within 7 days you'll issue it at court.

If they have any sense at all they'll pay up rather than run the risk of having a CCJ against them.

So far as the notice thing is concerned, if you said you were willing to work 1 months notice and they agreed the notice could be shorter, you won't have a problem.
