DH had driving Licence revoked because someone pretended to be him.

Hi,
I'll try and keep this as brief as possible!!
About a month ago DH had a letter from the DVLA stating that he had not sent in his licence for Endorsement after a trafic offence. It also stated that he had not produced documents at police station. This first letter was asking for him to send licence in asap.
The problem is.... that it wasn't DH's offence!. It happened up North in his parents home town and we live down south! Actually at the time of the offence we were all away in Jersey.

Anyway after lots of probing, it turns out that this driver was stopped in the same car a few weeks after the ofence and this time the policeman already knew him. Turns out to be a chap that my DH went to Primary school with and they share the same D.O.B
The police said they would look into the case and DH wrote to the DVLA with police case reference numbers. He also had to go to Court to state that he was not involved.
Today a letter from the DVLA turns up and says that DH's licence has been revoked because he has not sent it in , however he can still drive for 12 months!!!!
The police aren't being overly helpful and DVLA suggest he sends licence asap. DH does not want to sent licence as he says they will endorse it without a second glance and then we'll have major battle trying to get it reversed.
Has anyone got any ideas or suggestions as to what to do next?? DH has to drive for his job, therefore needs his licence. Thanks.

I would think he should send it to them with yet another explanatory letter, and if they do cock it up by endorsing it get a solicitor onto it asap. Here is a vaguely comparable case where the DVLA had to pay compensation...

If he's a member of the AA or RAC they give motoring legal advice, might be worth a call.

See a solicitor. Take his driving licence and any proof that you were in Jersey at the time of the offence - ticket stubs, use of his debit card (as on bank statement).

Get solicitor to write to police and DVLA.

Why not ring a solicitor and ask how much their fees are?

I don't know, but surely a meeting and a letter wouldn't cost too much?

You could try the CAB and/or your MP if money is tight and you can't afford legal advice - however, I think it's pretty obvious the DVLA would have to compensate you for any losses you incur. Can DH's work help as it affects them too?

Go to your local Citizens' Advice Bureau.

Horrible situation, but should be straightforward to rectify if you speak to the right people!

Thanks for your responses. Its a nasty situation to be in and i wouldn't wish it on anyone!
I think we will go to the CAB. I was talking to a friend today, she has reccently married and i suddenly remembered that her husband is a solicitor . DH is gonna chat to him tomorrow night to see if he can help. If not, he will put us in touch with someone who can. Its not really that money is tight, just the principle of paying out when he's not done anything!
Hunkermunker, the guy who's offence it is has apparently got an ASBO, but thats all we know at present.

Do you have legal advice with you motor insurance - its often included? Might be worth ringing them up and asking if they'd help..

Just spoken to the hotel where we stayed when we were in Jersey. They are going to send comfirmation that we stayed on the date in question along with the registration card filled in by DH. Also gonna speak to ferry company to get confirmation that we travelled across as they would've seen ID.
