Tax credits overpayment, being taken to court - advice please

Tax credits have started legal proceedings against myself & my ex for a tax credits overpayment.
As I have explained MANY times in the past to them. he won't pay his half and I have always been willing to pay mine.
They made arrangement for me to start paying the full amount which I refused and now they are taking 'us' to court. I have explained that I'm 99% sure he won't attend and now their answer is, is for me to pay the full amount outright if not see me in court!

I am fuming to be honest. Just wondered if anyone had any advice really - Thanks

All I can suggest is contacting CAB. I'm going through a nightmare with tax credits and all other goverment departments at the moment. Also another person to seak out is your MP.

3xamum is it child tax credits??? If so they nearly azlways 99% of time take overpayment from the current award and even then they dont take full amount but around a third.

were they paid into a joint account or straight into yours?

They were paid into our joint account.
What really annoys me is that I actually queried it when it was first awarded as I thought they were paying us too much! They told me not to knock it!! arrgg

Thanks for the CAB advice have phoned and made an appointment for next week

Socci they won't take it from our current award as I'm claiming with a new partner. Although they were willing to take his earnings into account to repay the debt!

£1500 in total. I asked if I was to pay the full amount would they chase my ex for anything , NO was the answer as it would be settled. Loooks like they have found there fall guy!

Tax credit peopl overpaid us a couple of years ago and advised us that they would take so much out of each years reward. therefore I am paiying abit off each year.

I had a similar problem - they wanted money back from myself and ex-h. They do not care who pays it as long as they get their money. It is irrelevant to them that you have split up.

I managed to wriggle out of it but only after 1 failed appeal, an official complaint and then finally I sent my paperwork to the independent adjudicators office and they then dropped the case. They then rang me 6 months later to ask where their money was as I still owed them. Turns out they hadn't updated their system. I nearly had a nervous breakdown!!! Well, that only took them another 3 weeks to sort out - idiots.

However, mine was a little different as I wasn't overpaid as such - they had sent the paperwork to the wrong address and had continued to pay us the same amount from the year before. We were entitled to that money but only if we had sent the forms back that they had sent to the wrong address.

Maybe I should just take my ex's view & ignore all official letters & lead the easy peasy life. Thanks for the replies

Ive just worked out today that Ive been overpaid. Im bricking it now. How will they take repayment. All of it from my account at once??
