Can dh stop me taking Dss abroad for a holiday?

I may be going to the US with my bf and the boys this year and Dh isn't happy about it. Does he have any legal standing? TIA

sorry U I really don't know. Hopefully someone will come on who knows. though travelling from Portugal to UK I have had varying experiences. Once, immigration phoned dh to find out if I had his permission to take dd away. Other times passport control has asked me, or check in desk... or nobody. Weird. I am Brit DH is Portuguese and the kids have British passports.

you each have parental responsibility for the children. you should consult about any significant decisions in respect of the children. if you have a residence order you can take the children out of england and wales for up to 4 weeks (unless there is any condition attached about not removing the children or any other orders currently in place preventing this). the onus would be on him to apply to the court for a prohibited steps order preventing you taking them. the test would be the children's best interests.... if you do not have a residence order then in theory you need his agreement or to apply to the court for a specific issue order..... what are his concerns? can these be allayed? (provision of full travel details / contact numbers / copies of return tickets etc)?......

cheers, we're still in the same house on speaking terms so hope he'll be ok? Just wanted to know my rights just in case.
