Help! Harveys Won't Give Me My Money Back

I bought 2 sofas, guarenteed Christmas delivery that haven't arrived, was offered £300 and they finally came January 9th. Thing is, the big one wouldn't fit (although we have had bigger before ) and they didn't try the other one... but we thought it might fit so changed the order to two two seaters. BUT, they have decided the offer of £300 was for the origional order only, so we just want our money back - but they won't give it back! No sofas and no money - what do I do? Considering they broke the contract first....

What contract have they broken? If you mean the "delivery before Christmas" part of the contract then they offered compensation for failing to deliver the original order and you accepted this, therefore this is no longer an issue. However, you have then effectively cancelled this original order because the large sofa won't fit so are not entitled to the £300 although you could argue that a proportion of that £300 compensation still applies to the 2 seater sofa you still want from that original order.

I agree that they should not have taken the sofas away and not refunded you the money though.

They offered but we didn't accept or get it. (the £300). I guess I will have to see what they say tomorrow... This has been going on ages now

Did you ask them to put the sofas in the garage when you realised they wouldn't fit ??

no.... they just loaded them back up and said "this is going to cost you alot of money" ??? I was just abit all over the place - I presumed they would deduct the delivery charge and refund the rest, not just take them away and not refund. If I had known this, I would have said "no, put them in the garage (you thieving bs)".

It is definatly wrong that they have the sofas and your money and for that I would go nuts.

I remember next door had some sofas delivered last year and they wouldn't fit through the front door and so they had to take the living room window out

I thought about the window option, but, the living room is upstairs (hence the problems) and even knocking out this funny storage thing that seemed to be in the way... but we took a massive sofa in and out of here 6 months ago (with a bit of pushing and pulling (and swearing!)) so I thought I'd just buy some elsewhere.

have you tried ringing head office yourself? the store manager probably isn't being very helpful because he doesn;t want to get into trouble and lose his commission. if you ring head office and tell them trading standards are involved and that your are going to put in a claim with the small claims court they may give you the money back?

Found out I accepted the £300 IF they were delivered on the 8th, which they weren't. Head office won't let me speak to anyone higher and will call back in 48 hours. If I don't get my money back at 10 when the store open, I am going to go down their with a big sign and sit on my sofas in the store ALL day until they give me my money back. I found out they were suppoed to offer choosing any other sofas, which they didn't.

We accepted £300 compensation IF they were delivered the 8th. They weren't. Just about to ring the store now, and all my confidence has gone!

The manager says he can't get my money back, he says I should have it, but he will ask his boss. But that was Friday so finding out today...

hang on, i am finding this really confusing. ur original order was for 2 sofas, i big 1 small? supposed top be delivered by xmas but they weren't so they offered u £300? then they were delivered on 9th jan but the big one didn't fit?so they tok them back?

Am i right so far?

so then u cancelled that order and changed the order to 2 smaller sofas?

Did u actually pay for the other sofas or get them on finance? and would the cost not have been transferred to the new order?

breach of contract is no good as it was you that broke it by not making sure it fitted, a new contract applies now that u have changed the order

Good. Suggest you go somehere where thy might assess for you in advance whether they can fit them through the access into your lounge

Well, we measured the ones we took out, measured the new ones and they were smaller... but it took some pushing and pulling of the old oe to get it out... I think they just didn't try very much. The ones I want now are smaller still, so, fingers crossed!
