HR related Sick Leave f**k up

on the 8th Dec got a sick not for 3 weeks.

came back to work this week on monday of this week

so
The sick note was signed on the 8th - this was a Friday.
week one was 11-15th Dec
week two was 18 -22nd Dec

Then we all had xmas week off 25-29th

Week three was 1st-5th January ( last week)

The confusion may arise becuase of xmas week. However I was certain only becuase the doctor specifically said to me that xmas is a stressful time anyway therefore he would give me an extra week after xmas.

Otherwise i would have had 2 weeks sick + xmas hols.

my boss says that last week isn't covered - well hes intimating rather than outright saying and adding "dont worry about it"

so ofcourse i am

can anyone help?

GP? Will he not issue one retrospectively...especially if you make it quite clear that your lurvely boss is stressing you out more because of the ambiguity?

I have never come across a situation where a weeks holiday is bridged by one sick note IYSWIM - therefore a 3-week sicknote covers 3 consecutive weeks regardless of whether one of those is a 'holiday' week - as prevous poster, you will need to get a retrospective sicknote from GP for last week (most do it I believe)

yes marina doc will prolly help me out - just wanted to know about the situation before i go doesnt the note cover it though?

i mean or else i would have had 2 weeks sick ( on record) and the xmas hols everyone else gets

dont want 4 weeks on record!

sorry Custardo - the other posters are right - it's 3 weeks from the date of the sick note even if that coincides with holidays or a shut down. you will need to get a sick note for the first week in Jan.

Our hr department would take the line that you're either sick or you're not. You can't stop being sick for Christmas and then get sick again afterwards, that's taking the p*ss as far as they are concerned. You are not alone in trying this method to keep your sickness record to a mimimum though

Surely if you stopped being sick at Christmas and the started again afterwards that would count as two episodes of sickness which to some employers is worse than one long bout of sickness.

I don't think you get your holidays back if for example you got flu over Xmas, it's just tough luck.

I say this as someone who routinely gets a bug of some sort over the Xmas break.

The sickpay guidelines/rules are there for those who genuinely need them not for people to play the system with.

i am not using my holidays and and a sick note.

if the sick note covers it - then i have three days holiday added to my holiday leave - which we can take at any time becuase we are multicultural and up to date here doncha know.

You do sound as though you are trying to play the system a bit and I'd therefore be well careful of trying to outsmart your employers, maximising your time off for minimum impact on your employment record.

Employers have started to refer people for "discussions" regarding sickness and have "return to work" interviews for just this reason.

if you are sick when you have booked holiday you are entitled to you holiday back.

You were either sick enough to be signed off work for 3 consecutive weeks or you weren't.

Are you saying that any employee who got sick over Xmas/ New Year should ensure that they get a sick note so that they can still have a day off later when they are fit and healthy ?

A future employer would surely be more put off by an employee who plays the system to maximise their own personal gain rather than someone who was genuinely sick for a 4 week period.

you are entitled to your holiday back.. you can't be sick and on holiday at the same time... you were sick, therefore you were not in a position to take your holiday.

Aha, a booked holiday would be different to three bank holiday days. Perhaps you are talking about annual leave days instead of the three bank holiday days (25th/26th and 1st)

i think you aremisunderstanding

every employee gets a certain amount of annual leave a year.

for most people they save 3 days for over the festive period to celebrate xmas - this is done in most industries.

We are a very up to date on the ball company regarding equality and diversity issues.

the three days for some employees in most other companies are holidays which MUST be taken over xmas. there is no choice.

I have a choice.
