credit company wants to make me bankrupt HELP AND ADVICE PLEASE

just had a phone call from a debt recovery place and they have just told me on the 19th of jan they are putting in a petion to make me bankrupt, i dont know what to do we have no money at all and im pooing my self right now dp is on his way home and ive got to tell him.

they had the creditor who we owe money to right and the amount.

We went bankrupt last february pertioned ourselves.
I presume from what you say your debt is being handled by a debt management company.

In the income expenditure for include all creditors and you need to make pro rata payments to them all,just because this company is shouting the loadest doesn't mean they get the most money.

Try National Debtline - there is a telephone helpline and they are free, independent and a voluntary organisation (like CAB). Otherwise find a local voluntary org at CLS Direct - this also contains details for solicitors, but it is probably a not for profit organisation you will want.

if you are dealing withe a DMA then make sure they are aware of what's happening. also what is the name of the company who are on aboutt eh debt - I ask for 2 reasons -

1. a company rang DH offering him a loan and said but you can use it to pay XYZ off- was our exact amounts on a creditcard and catalogue - we'd not delt witht eh company before.

and also a debt management company tried the same thing with us and DH's mobile phone - I searched hte compnay and it retuned nothing rang TS and they said it was a scam.

if you are sure 100% this is right then ring CAB, and also speek to your creditor (HSBC or whomever) and say X has rung have you sold his debt? are they dealing with this on your behalf - just double check before you pay anything out.

How much do you owe them? It will cost them a fair bit to make you bankrupt, they are probably just making an empty threat.

Do you own your own home? is there much equity in it if so? It may not be the end of the world to go bankrupt if you are renting, especially if the debts are causing you so much stress.

Chin up, they can't hang you for it, or send you to prison.
