some idiot has smashed into my car and there is a great big dent in it

yeasterday i was down at my mums and my car was parked outside the house. when i was going to take my mum to the shop the guy accross the road from her was standing next to my car. i walked round and he said we were reversing and we gave ur car a wee bump. i had a look and there is a great big dent in my car. i am so angry. what if the damage cost more than what my car is worth and they write it off

its a right pain im having to pay an excess then claim it back of their insurance

At least he didn't just whack it and run. It is a PITA, but these things happen and at least you can claim off his insurance and sort it out.

the worst bit is i think it was deliberate. they were parked in thier "drive" and i was at the other side of the road and it looked like it was a straight on whack. they have no mark at all on their car and it looks like they have touched it then just kept going.

they dont like my family and hate it when we are there. they like to call the police for the silliest wee think like my dad had to fix his tax disk holder so he took it into the house. the car had no tax displayed for an hour at the most and when he put it back on he had a ticket

my MIL has eighbours like this
the asked us to move our car {which was on our side of the road as they could not get out of their drive } on christmas day ffs luckily one of us was not drinking but they are gen pathetic
once my ex was dropping my daughter off at my mil and parked opp their drive he was going to be 2 mins a most but no this old bloke well he was out shouting the odds but my ex is very stubborn and sat in his car for 30 mins doesnt like being shouted at (see why he is my ex lol)

You shouldn't have to pay anything , so there shouldn't be any excess to try and get back off him. If he accepts liabilty for it, which he has by saying he did it then get your insurance to claim straight from his.

A similar thing happene to me and I didn't pay a out a penny.

If you have all the details of the offending car and the drivers details then your insurance company will find out who his insurance cmpnay is ( all on a shared database nowadays ) and do all the donkey work for you.

As your car was stationary and unattended he really has no excuse .

ah but you may have to pay the excess in the meantime. My mum was driven into by a lorry in June and her insurance company are still attempting to recover the excess from his insurer. However when she had it fixed, promptly and at the place her insurer arranged, they would not hand the car back unless she paid up, so she had little choice. Do you have legal cover with the policy ?

yeah i have legal cover. his insurance is withroyal and sun alliance motobillity does any1 have any experience with them

If the repairs are more than the car is worth they may well write it off.
You can argue with the insurance company if they under value your car, for instance if it has recently been renovated, is extremely low mileage and good condition (before the bump) or its special in some way (limited edition etc.)
If they do write it off you will then be able to buy the car back off the insurance company at a scrap value. You will then have your car and some money (whatever the insurance company value it at) and will then be able to get it repaired yourself. It will probably then have a "Category D" write off against it's history.
All depends on what car you have and it's value to you (including sentimental value?) whether it's worth doing.

I hit a car when I was reversing off my drive. I also have a motability car. I know that I had to report it straight away. They dealt with the other person's car quickly. I hit a stationary car and therefore I was fully at fault. He can't get out of it

oh dear, i was just going to ask about this, I have hit a neighbours car by revearsing off the drive tonight. It is going to be sorted by our insurance company. but i couldn't get the car off the drive so wondered if i have any rights, like her car was causing a obstruction.

Panda girl I dont think you have a leg to stand on. If the car was causing an obstruction then you should not have attempted to move yours.

If you are driving and hit a staionary car then you are totally at fault.

It would be like trying to drive down a narrow street with cars parked both sides which are causing an obstruction but you still have a go and knock off all the wing mirrors .

i thought that was the case, thanks anyway.just thought it was a bit strange that when the police was talked about coming the womans boyfriend moved the car down the road away from blocking our drive. thanks anyway

yeah she gave me insurance details about 30 mins later, but im not so sure why they moved it so quick, thats what made me think they should not be parked there.
