medical negligence

i wouldnt mind a general consensus on what you guys think

someone i know is making a med neg claim and has to decide when he thinks the negligence occured, as you have 3 yrs from the day you think the negligence started ti make a claim. His initial injury was in aug o3, but he didnt get anything other than physio until june 05 , and hten had to wait unitl jan 06 to have surgery.

i think until he was given a diagnosis he would be unaware there was negligence because he wouldn't have known what the correct procedure should have been until then,and should give the june 05 date instead of that date of the actual initial injury

is this correct do you think?

do his problems stem from the original injury and was he misdiagnosed then? (I'm a bit confused tbh!)

From what I hear MN cases take eons and persistence from the claimant.

his problems do stem from the initial injury, mainly because they took so long to diagnose and treat him

someone else he knows who had an almost identical injury after him was picked up and dealt with a lot quicker and has made a significantly faster recovery

so in effect, what i said about him saying the date of neglect being june 05 is correct then, because it was then he realised he should have been treated quicker and differently

they treated him as general lower back pain, but he actually had a large disc compression which was pushing on his thecal sac , and he ended up having a discectomy over 2 yrs from initially complaining of pain

I would imagine it would be very difficult to prove that he did have the disc compression initially and not another pain or injury that has subsequently developed into a prolapse.

he didnt

he is in the army , it happened during 3mile bergen run

if he had back probs before it would be in his medical notes, because of fitness for duty issues and it isnt

Thanks irishbird, he is getting help, but he was worried his 3 yr time frame was running out, i said it would be from when he had knowledge of negligence but just wanted to make sure
