Hi, I'm new but seen some great advice on here so thought....worth a shot.

Sorry, I need advice about a possible CCJ. My husband received paperwork for attachment of earnings and its the 1st we knew about the debt (long story got in a bit of a mess after his brother then mum died). He doesn't want work to find out and wants to offer payment himself via direct debit each month. Can he do this, do you think its likely to be accepted. Thanks in advance for any advice

If he's got a notice for an attachment of earnings then the CCJ will already be in place.

Have you received form N56 from the court? If so, then you can ask the court not to make an attachment of earnings order if the creditor will agree to payment plan. This is a "suspended attachment of earnings order". There's a box to tick on the N56 form and you'll need to give reasons. If the court agrees then they won't set up the attachment, unless you fail to pay as agreed with the creditor.

I'm not sure if they will still tell your employer though. You could ask the court whether they would?

Also - you MUST send back the N56, if this is what you've got. It's an offence not to - and if you don't then bailiffs can serve an order on you to fill it in and you could end up in court.

Thank you! He's received a N55 form, did the worse thing and googled it, loads of conflicting stuff and got nowhere!
He's filled the form in and done as suggested and ticked the suspended thing! Thank you so much for replying! Will keep fingers crossed! Smilex
