Hello...don't know if this is in the right place or not but need some advice/facts please.
Have 2 sons, both reside with me now...16y old has done since last Sept full time....Ex H pays nothing towards their keep (one 18, other 16, both full time education) He still claims CB for the youngest and I guess any TC that he may be due...he is finishing off a PGCE course or so he says at a School where he has been working as a TA...Is this legal that e can claim this money? Neither son visits or stays often as he is too preoccupied with Japanese wife and study... I work full time + but its actually making me ill ...His argument has always been 'that I earn more ' so why should he pay?I'm a Nurse so not on massive earnings ...just a hardworker...but cant keep this up...he will actually get taken on as a f\t Teacher in Sept if he qualifies....shall I persue then or just ' leave it'?
I just want a fairness to my boys...

Sorry, who do your teens live with most the time?

There's a lot of information in there that just looks spiteful rather than relevant, sorry. Better to say "ExH is generally a prat" and not go into details.

If they both live with you then obviously he should not be claiming CB and TC. AFAIK he has three weeks to inform them they have moved out. To continue to claim is fraudulent.

If both kids live with you then you claim the child tax credits and child benefit for both kids. If the one he is claiming for doesn't live with him then he shouldn't be claiming it. he should also be paying you a percentage of his earnings, i think 20% for two kids.

yes exH finishing PGCE...What I was purely asking was ...Is it right that he still claims CB for my youngest son when he does not live there...nor does he pay for anything for them...(he will also claim TC)... Its the principal of it.... I have done everything for my boys...This man will stand up and Teach boys with emotional and behavioural problems yet cant even support his own two....boys...and I don't mean just monetary...Yes fraudulent isn't it...time I claimed it back and made sure it goes to where it should!
Perhaps that comes across as 'spiteful'...

Surely CB goes to resident parent? I would be making a few phone calls. Perhaps one to the CSA (or whatever it is called nowadays) while you are at it
