Housing benefit when you have a mortgage

Hi me and my husband are separated. We own a house together but there is a small equity in it. I think it is probably better for myself and my DS to move out and and I don't think I can afford to live in our existing house on my own. I don't have any income at the moment, but to stay with my mind I have to move out.

Does anyone know if I would be better to get my name taken off the mortgage in order to claim housing benefit? Also, are you allowed to claim housing benefit if you leave a house voluntarily . Could I put in a request for a council house / housing association house whilst we have a roof over our heads?

Sorry, more questions than I thought then. I just want to be prepared for when I have to make final decisions about what we do so any advice gratefully received.

I think you can claim if it's the former marital home and you are living elsewhere if it's up for sale or if you've fled dv.

If the house is sold and you get equity this capital will affect an ongoing claim..

How much equity do you have? As that will impact on your options.

If it's short term you can claim housing benefit while also owning a property for example if waiting to sell, and house is on the market.

You may be able to apply for housing association / council, but you won't be a high priority so could be waiting years depending on your area, and if you have a certain amount of equity in the house then you wouldn't be eligible at all.

Thank you. After we pay the bank, and the 20% to First time buyer, and all the debts it wouldn't be more than 5000 for me. I prefere him ti have the house, because he can pay for it.
