Help re legal aid, joint accts etc (long sorry)

Am awaiting the court hearing after h attacked me whilst drunk - whole story in a chat thread.

Am not working - so have been dependent on his salary for mortgage etc.
We are now living apart (he on bail),I need to get some financial help (have appt with 'law for all' next week and need to sort out income support or something)
BUT....
I have saved the kids child benefit for them - so have a sum in an account... will this be classed as my savings (and held against me re legal aid etc)?
Can I move it into a childrens account - with their names on and so it won't be classed as mine or husbands?
also - our joint account is overdrawn, and I don't want him to make it worse (possible vindictively).. is there anything I can do about this now?

Hi, I don't do Legal Aid anymore, but I seem to remember that if you have any savings in an account in your name, that will have to be declared when you make your application. You're allowed to have a little bit of money (look at legal services commission website calculator) in your own name without affecting your application, after that you'll be expected to use part of the savings towards your costs. Therefore, transfer the childrens' money into an account in their name BEFORE you apply.
So far as the overdraft goes, tell the bank to put a ceiling on it so your husband can't run it up above where it is now.
