another ebay question - stolen goods

I've bought something off ebay which I've been told by the original suppliers is stolen. Does anyone know legally where I stand?

The supplier told me they'd like it back (duh) but then someone else from the company called and said they'd claimed for it through royal mail, so it might be their property instead. Haven't heard from royal mail or police who they said were involved.

Have emailed ebay twice with no reply, have also emailed paypal.

Any ideas?

I take it it is a bit more unique than a little tykes toy them. Do they post direct to customers themselves?

I can't find my ntoes on this. I THINK that if you buy a stolen item and are made aware of the fact you have to return it. You might be able to claim off soembody for your losses. If you had already sold it on, unaware of the fact it was stolen, then you would not be pursued. Its really annoying, I studied this!

I previously worked for a computer copany that sold goods to PC world etc and EVERYTHING was tracked via serial number so we would know what exact unit went to which cusotmer so in cases of items being lost via couriers etc we could track that unit. The manufacteur would ahve been reimbursed for the item via the insurances etc however I would assume that the warranties would be null and void as the unit has been 'written off' so to speak. I guess your issue (or one of them!) now has to be with the person who sold it to you as you have bought a unit thinking it was within warranty, which in fact void. I hope this helps get some understanding! Sorry its not a solution

I didn't buy it within warranty as such, it was sold as new but from a personal account, so I just assumed it was surplus to needs - looking further into it they have more for sale.

The only thing I can think of if it's legitimate, is that if insurances have paid out etc then it's just 'doing the rounds' now. But I'd have thought royal mail would have returned item to manufacturer at least.

I've finally had an email off ebay, who said I need to report it to the police myself. I can't see this being very productive lol and have no idea which department to contact.

I'm SO annoyed right now!

LIZS - no it's not a little tikes toy that was a very bad example I just don't really want to make it clear what it is as it would be v. easy to see who the seller is and I don't want to be inferring anything upon them that isn't proven yet. Although it most definately isn't brand new as described!

bollocks, if they're selling stolen goods people should know.

I am shocked at ebay's reaction tbh. the seller should be delisted.

Hopefully they will be as they have more of these which I think indicates they must be involved somehow.

I've phoned my local police who are referring it to be dealt with. Hopefully will find out more.

I've heard a lot of stories about 'dodgy' things on ebay but have been so lucky at never being involved before.

I don't know just customer support type people.

Am rather peeved now, they've emailed me back and told me what to do, which is as follows:

"I'm sorry to hear that the item you received was faulty and it was
possibly stolen item.

To resolve this issue, there's a couple of things you can do now:

  1. Talk to the seller
  2. Report the seller to PayPal "

they go on to say I can request the sellers phone number, I need to do this (which incidentally sends the seller my phone number at the same time 'to make it fair' ) and then talk to them. Then if it's not resolved I need to report them to paypal.

Uh, if the item is stolen, why on earth would I want to phone them and accuse them of it??????? Giving them my phone number - when they already have my address - at the same time????

launch the dispute consol, but then you only get your money back if it's over £50 and then ebay charge you £50 to sort it out.

Report it to paypal ASAP, and contact the police.

I bought a bluetooth headset off ebay a while back, it was described as new but wasn't, the guy asked me to return it and then refused to refund or exchange, so I lost my money and didn't get the item and ebay wouldn't do anything as it was under £50......
