in june went on holiday and as i have no cards a friend paid for it on theirs. just had a letter from company saying they did not take the money our of the account so i have to pay them £800 by today. spoken to the person whose card it was and they tell me they did not realise and although some may be available the most of it has been dipped into. can believe him as hes useless looking at statements. where do i stand on this do i have to find the money immediately or would they have to give me bit of time. any help would be great. thanks

right, im confused, but i think the general gist is...

you booked a holiday away but as you dont have a debit card/credit card, a friend put the price of the holiday on their card.

You I assume gave them the money?

This friend now hasnt got the money to pay the holiday company?

Is that right?!

SenoraPostrophe · 01/08/2006 17:15

since you've had the holiday it's effectively a debt, so if you make a reasonable offer (eg half now, half in a month or something) they won't be abe to do anything about it.

if you haven't had the hol then they can just cancel it.

Not sure I fully understand the situation. If it was on Switch wouldn't the payment have gone through straight away or been rejected the time. Seems odd that you were still able to go since most holiday companies require payment in advance.

seo sorry i was trying to be breif as not to go on but have not made it clear enough. yep when i booked the holiday i put the £800 in the account and just expected it would come out in 3/4 days as usual. as it wasnt my account did not check. i actually did have a visa electron but they would not accept it it needed to be switch. so went on hol as plannedsnow got a letter to day they didnt take it out - no reason why.(that that they tried and couldnt) they never even tried as had proper acc. details and everything as rang a couple of times to make sure. single parent going to my own so bit panicky. they sent tickets throught post so i thought everything was fine. tbh i wish they took the money when they shod have. thanks

So where's your £800 ?

Northerner · 01/08/2006 17:36

Eh? So who's account did you put the money into. Surely it's their fault that they didn't realise money had not come out.

I'd tell holiday compnay to contact the card holder.

SenoraPostrophe · 01/08/2006 17:39

no - they do an "auth" when you book and then they're allowed to take the money at any time within the next 6 months. Our local co-op's machines broke down once and they took 3 months' worth of shopping bills in one go - ouch! (ok so I shouyld have noticed, but I didn't).

Like I say, I suggest you phone and tell them what's happened, offer to give them whatever your friend hasn't spent this week and the rest after he gets paid (presumably).

mysonsmummy · 01/08/2006 23:02

just found the letter explaining why the money hasnt come out of his account. it says it was because of a system error - ''please accept my assurance that this non-payment is entirely due to an error on our part and that there is no implication that you are at fault''.

i am bit fed up because if they had took the money when i booked the holiday i wouldnt be in this situation. at the time i was desperate to get it booked but the chance of me getting the money back off him any time soon is low.

just asking where i stand really about being able to pay it off bit at a time. thanks.

Im confused sdurely whoever's accoun t you put money in owes the £800 not you.

LIZS · 02/08/2006 08:22

Don't really know but hopefully it means they'd be amenable to paying by installments, you can only try. Meanwhile you "friend" has stolen your money (presumably he's spent it himself ?)

spangles · 02/08/2006 09:44

surely its your "friend" that owes the money... not you.

mummyhill · 02/08/2006 11:16

If you put the money into a friends account and it is now gone but not to the holiday company he should give you the money back straight away so that you could make an offer to pay by other means. If he/she has spent the money or is not giving it back it is theft and they aren't much of a friend if you ask me.

dizzybint · 02/08/2006 16:54

problem is that you went on holiday so the 'contract' is between yourself and the holiday company surely. so they want their money from you. you then also have a problem with the person who's now seemingly spent your £800. have you explained the situation to the holiday company? they may show a little flexibility as it was their mistake in not taking the money sooner.
