Claiming MA and dh working for free to continue my business?

I am self employed as a sole trader. DH is a SAHD.

I am due to claim Maternity allowance but do not want to / am unable to completely close my business (online) side of it.

I understand I am only allowed 10 kit days. DH can keep it ticking over for me but rather than register him as self employed/partnership which will require a change if name for bank accounts etc... I was thinking that he can work for free and I would continue to draw the money.

I understand this is ok as long as info not physically do the work.

Would he still need to register as self employed whilst working for free? Is there any problems in working like this?

I can't see a problem with him working for free, but you/he needs to keep a record of what he has done so there is some evidence that he did it not you, otherwise you will exceed your KIT days.

There is no need to register as self employed if you arent earning anything.

(You could consider paying him. Paying him will reduce the profits on your business so the business will pay less tax. If you were to employ him for three hours a day at the minimum wage he could register as self employed and apply for a Small Earnings Exemption Certificate so he pays no tax/NICs. Whether you think this is worth the hassle is up to you, but you could discuss it with your accountant.)
