Oh God - nightmare. Suspect you will have to throw yourselve on ex-DP's mercies. I would imagine the bank have no obligation to sort it out as you gave them the wrong details yourself.

Good luck - I know that won't be easy.

If he knows that that money isn't his, then he doesn't have a right to spend it; same as if his bank accidentally paid him some money which should have gone to someone else's account.

You will have to ask him to return it and, if he refuses, I would contact the police and report him for theft.

is there not a clearing period? or has the time elpsed got that? - ie if u pay on mon it will clear on thurs but not b4 so if u're in those 4 days you can canclee the transaction and start again.

failing that any chance your back can retract the transaction?

Would the Bank not make the approach for you? As you've changed banks, he may not realise it's from you, so not be difficult?!! Grasping at straws I suspect.

Freckle · 05/07/2006 13:11

I was thinking this too. If the bank approach him and say that they have erroneously paid this amount into his account, he may return it quite happily, ignorant of the fact that he is paying it back to you.

Can you warn your landlord? Explain that it is a bank error - you don't have to say exactly how it occurred - and that you are expecting to get the money back, but are not sure just how long it will take.

How well do you know/get along with your landlord?

Amanda1, would it help to immediately start paying your landlord back little by little? So she isn't left with the feeling that you are saying 'well, tough, I can't pay now'?
if your ex=p had an overdraft he won't be able to give the money back straight away, even though he wasn't entitled to have it.
