Any tips on IR35

Does anyone have any experience or tips on how to ensure that you don't get caught in the IR35 tax?

Work for more than one company and geniunely contract!

You just have to ensure that, if you look through the company, you're not effectively an employee.
There are several self-employed indicators such as:

  • can you substitute someone else to do your work?
  • do you provide your own tools/materials?
  • you have a contract 'for' services rather than a contract 'of' service
  • flexibility regarding place/hours of work etc
  • non-exclusivity clause on contract

It can be a bit of minefield and each case depends on its own indivudual set of circumstances.

Join the \link{http://www.pcgroup.org.uk/cms/index.php\Professional Contractors Group} - well worth the subscription fee and includes Tax Investigation Insurance. They hold lots of IR35 seminars and have a forum where you can ask questions about IR35.

CountessDracula (great name by the way!)- my DH has recently resigned and decided to contract (right after we moved and our DD is 7mths old!!! talk about timeing). so I am looking at all the potential issues we could come across as well.

are any of you(s) contracting?
