Absentee Father calling round and threatening with court action...

not mine but a friend's.

ExP vamoosed shortly after their kid was born (4 years ago) and I believe they are divorced. I don't know the how and why's of the split as I don't like to pry and I met her after the split and she hasn't volunteered yet.

Anyhow, every blue moon the ex shows up unannounced demanding to see his son which my friend does not agree to.

Yesterday afternoon ex called round again this time threatening with court action.

Saying that, she can't realy see him do it as he hasn't paid a penny of child support so far and surely would be 'hit' if he takes the matter to court?

He again called around later in the evening, but my friend was in the back garden and didn't open the door at all.

I've offered to go round tonight to stay with her but haven't had a reply yet. Don't know whether he is the violent type iykwim but she seems rather shaken.

Also told her to report any instance of him coming round uninvited just in case it goes to the courts.

Any other suggestions or tips how to handle this?

my ex didnt see dd for 8 years (his choice) and never paid a penny, yet still applied to court for access and got it.
I'm afraid that they have little interest in the money side of thing or how long the parent has been absent, all they think is that a child should have the opportunity to have a realtionship with both parents.

Sorry probably not what your friend needs to here

That's just soooo wrong!

at least imho I think that if they can't be bothered to be around when they are little they forfeit their right to partake...

in my experience a contact order will be granted whatever the circumstances! including violence!

if the mother does not follow the order then she is fined, jailed or even the judge will give residence to the father.

if the father does not follow the contact order then there is no penalisation at all and its fine for fathers to pick and choose when they see their kids

family law is totally effed up!!!
