'Bedroom tax' and disability

Hiya,

MIL has recently had a letter saying about the changes to benefits and I wondered if anyone knows of a similar situation and potential outcome?

MIL lives with her husband and son in a 3 bed council house. Her husband and son (18 years old) both claim disability living allowance.

As I understand it, they have a spare room which they will either have to pay 14% of their housing benefit, or downsize.

However, MIL's husband is seriously ill and his health is deteriorating. There will be a time when he will be too ill for him and MIL to share a bed. Their bedroom is too small for 2 single beds, so they would need to spare room for one of them to sleep in.

Would there be any exceptions in this case? Or would it either be 14% or downsize?

(MIL is going for an advice meeting with council on Friday, and of course we can get more advice from CAB - just wanted to come on here to see any other views/experiences)

If they need separate bedrms for health reasons they may be able to apply for discretionary housing benefit to cover the shortfall.
