Well, the buying of it anyway.

We agreed with the seller that we would pay full asking price if he paid stamp duty.

Now the house was priced at 125k, which is now the ceiling limit on the stamp duty free properties

We are due to exchange and complete on Friday. Would there be any potential that the seller will try and delay sale for a week to avoid paying duty? And where would we stand legally if he did? Anyone know how the implimentation of this new limit works at all? Am quite worried!!

hmm, have just looked and seen that it is in effect from 23rd of March. Does the fact that we agreed to pay the full asking price less the amount he was going to pay for stamp duty mean we are entitled to monies still? Or will it mean we have just lost out a little? (well enough to sort the roof and the damp so actually not a little to us, but not the whole house!) Grin

Could you negotiate to lower the price you are paying by the amount of stamp duty that would have applied? that way you will be slightly better off financially, and he will be no worse off as he wouldn't have to pay stamp duty now.

Agree with gdg , split the saving, win:win . If it was worded that he would pay whatever stamp duty was liable and now there is none he could stand his ground and pay nothing . Preusmably nothing is signed yet anyway so it is still up for negotiation until exchange.

on a more positive note I have looked at other houses in the area and they all seem to be going for 10k more now at least. Ah well.

TBH, I know it sounds a bit miserable/money grabbing but if I were in his position I wouldn't split it either, unless I thought my buyer would pull out. I know how that sounds but at the end of the day, when you sell your house you want to take as much equity from it as possible. The buyer (in this case, you) agreed to buy it at full ask, so long as you didn't have to pay the stamp duty. He'll just turn around and say 'well, you still don't have to pay the stamp duty, do you ?'.

I know NdP. Its just that there is quite a lot of work to be done to the house which he was also a bit unreasonable about. Not thinking about him any more. Hopefully in 5 days time I will have no further reason to!!
