Should i be getting job seekers/unemployment benefit?

What else might i be entitled to? I have NO clue about these things.

Ive been in employment for years but left my job at the end of my maternity leave because my manager was awful. Have been out of work since October 05 officially. My DP lives with us and has a job - will that make a difference?

I ask because things are really tight for us know.

I think you can get JSA. Phone the DWP and find out what you are entitled to, have you claimed CTC and WTC?

Nemo1977 · 13/03/2006 00:01

would have thought you could claim either jobseekers or income support. Do you still suffer from pnd?? If so you may be able to claim incapacity benefit if you are unable to work due to depression etc.

julienetmum · 13/03/2006 00:03

You won't be able to get JSA as you voluntarily left your previous job.

If your DP is on a low income, or if he were to become unemployed you would probably get Income Support. You do need to tell the tax credits people as depending on your DP's income you may be entitled to more tax credits.

julienetmum · 13/03/2006 00:04

Ah, just noticed you left your job back in October. In which case you may get JSA, I think there is a time delay but I'm not sure how long where you can't claim for a certain amount of time if you have voluntarily left a job.

JSA will depend on your NI contributions record though and it does only last for 6 months before you go an income based one which is dependant on your partner's income.

sparklymieow · 13/03/2006 00:05

go to \link{http://www.entitledto.co.uk/\entitledto} it will tell you want you can claim.

VeniVidiVickiQV · 13/03/2006 01:26

Ah - thank you.

I did resign from my last job but i am currently claiming unfair dismissal - am awaiting a tribunal date so does this make a difference?

Im not getting any tax credits atm - im entitled as such but they made a cock up - whats new - and overpaid me drastically 18 months ago and have stopped payments for the last year to recoup it. We are talking 3k overpayment......

Its considered that DP's salary is good in terms of gov stats.

i dont know about the benefits side. i am on benefits but am a lone parent so i assume its all different. i have been to a tribunal though so if you need to know anything about that or need support then just ask away.

VeniVidiVickiQV · 13/03/2006 01:36

Thanks nightowl.

Atm i am just waiting to hear back. I have had confirmation and a copy of my ex employers response.

I assume the next thing is a tribunal date?

OP posts:
nightowl · 13/03/2006 02:00

did you have a case discussion? i waited...(uummmd and ahhhhd) about it for nearly the whole three months until i decided i would take them to a tribunal. (this was the aug). we never got a response until the january (the same day as the case discussion, they actually brought me their response in the tribunal waiting room). the actual tribunal was set for the next june.

nightowl · 13/03/2006 02:12

i noticed you resigned..is it constructive dismissal you're claiming for?

VeniVidiVickiQV · 13/03/2006 10:17

Constructive dismissal and sex discrimination relating to issues with my working part time and (the constructive bit) their lack of response in wanting to deal with my complaint.

Does anyone know if the jobcentre will back date my claim?

VVV even if you are not entitled to any benefits you must let them know as you have to keep you national insurance contributions going and they will prob pay this for you as this affects you for your pension and also if you are entitled to benefit in future it is calculated on the last 2 years and if it is missing it could affect you getting help in future, hope I have explained this properly!!

muma3 · 13/03/2006 10:25

you can get child tax benefit and working tax benefit depending on partners salary/earnings. i think it under 14.500 then you will be entitled hth

iota · 13/03/2006 10:29

re the NI credits - if you are in receipt of child benefit, you get HRP ( home responsibilities protection) and do not need to 'sign on'

VeniVidiVickiQV · 13/03/2006 10:33

Thanks MG - ive had pnd so been really slow at getting things sorted.

muma3 - the inland revenue considers DP's earnings to be too high - not sure how they calculate the cost of living in london mind you.

Thanks iota - most helpful!

muma3 · 13/03/2006 10:35

muma3 · 13/03/2006 10:35

cant* help Blush

iota · 13/03/2006 10:37

VVV , as others have said, you really should phone the local Jobcentre office and ask for their advice about claiming JSA.

VeniVidiVickiQV · 13/03/2006 10:38

Thanks iota - did that about 20 mins ago Smile

Got to wander on down there today.....with my two.....oh joy!

OP posts:
iota · 13/03/2006 10:42

well done - hope it goes OK - I use to work in the unemployment benefit office many yrs ago, but it's all changed now, so couldn't give you any current advice.

iota · 13/03/2006 16:16

VVV how did you get on?

VeniVidiVickiQV · 13/03/2006 17:33

Ive got the forms today - got appointment to go back tomorrow will all the relevant paperwork to go through it.

They dont know if i am entitled to anything or not because i couldnt remember if my maternity pay covered class 1 ni payments or not. I also didnt realise that you have to agree to look for full time (40 hours a week) work.

Although the lovely lady did say that although you have to agree to look for full time work, if you take a part time job then it doesnt matter.....Smile

So we'll see tomorrow anyway. Thanks for thinking of me iota.
