My husband's Dad has a brain tumour and is going down hill very quickly so it is a very emotional time for all.... without going into too much detail my hubby's mum also passed away from cancer 9 years ago. My hubby's father wanted to get his will in order for obvious reasons. He has decided to have the house sold as soon as he passes away and put half into trust which will pay out a yearly salary to his current partner (Aged 56) which when she passes away will then go to his 7 grandchildren. It's a very sensitive subject but I was wondering if there are any areas to watch out for with trusts and if anyone else has had a smiler set up after a family member has passed away especially if it involved a dis-jointed family as well. I am keen for once my hubby's Dad has passed away there is not years of more stress and upset from a hasty set up made in a time of upset. Many thanks Mandy

Loads of areas to watch out for with setting up trusts, appointing trustees and inheritance matters generally. That's why the person setting up the arrangements (FIL) needs good solicitors every step of the way to make sure there are no ambiguities, no assumptions and his intentions are carried out faithfully.
