Statutory Sick Pay

My husband is off work at the moment, he has just donated his bone marrow to his sister. He was in hospital for 3 days, discharged on Tuesday. He is very tired and still sore so really shouldn't be back at work yet. He went into work today to fill out a self-certificate and has been told that it will have to either be unpaid or he will have to use holidays. He doesn't have enough hols because they took an extra 4 days off him for his paternity leave and he would need 2 or 3 weeks. Is this fair? He is entitled to full company sick pay if he is off but they wont even pay stat sick pay. I am beyond fuming.

He will need to check their policy - some organisations discount "self inflicted" sickness (ie sporting accidents / cosmetic surgery), and they are somewhat harshly I feel) lumping him in that category.

Not sure about SSP - I am sure someone more knowledgable will be able to answer that one.

There's nothing to say he wouldn't be eligible for it (unless he earns under £107 a week) and there's a phone number to challenge the employer's decision.

Regarding the company sick pay, he needs to look at his contract / employee guidelines (we had them on work's intranet at my last job) and see what it says about when it will be paid. If there's nothing to say he wouldn't get it paid if self inflicted, they are on very shaky ground and I'd be challenging them about it.

(I know it's not exactly self inflicted but just trying to think of any other reason they wouldn't be paying it.)

thanks for the advice, he spoke to his manager and it turns out his hr lady is a cold heartless cow. its up to the store manager and he is happy to for DH to be paid.

Just read this, what a horrible HR person, Jobsworth or what??! Sort of thing which if publicised in the papers would be very very damaging PR for that company (not that I'm suggesting you do that of course!) What a lovely brother and I hope your SIL gets better soon.

Thanks folks. SIL is on the mend, she has still got a long road to go though. DH family and I suggested papers at the time but he said no, because it could affect his colleagues. Had he told them where to shove their job as I suggested it would have been in the papers.
