oh another legal question :}

My boyfriends's dad still pays spousal support for his ex wife who he divorced in 1970. Its the heady sum of two pounds a week but he has dementia and cancer and has since been married to my boyfriends mother [she subsequently died]. He is 82.

So my question is does he have to continue to pay this or should it have stopped when he claimed his old age pension? There were no dependent children from that marriage.

It depends on the terms agreed at the time, I expect. If it was 'for life', for example, then he keeps paying. Is it causing him hardship to find £8/month?

No it isn't. He is on an Old Age Pension but if I am honest I don't think a man who is in his eighties should still be supporting a lady who divorced him nearly 50 years ago regardless of how small the amount. My boyfriend is filing the papers to have it rescinded.

I doubt she'd bother to take him to court if he stopped paying. It wouldn't be worth the fees.

I know it may sound that I am being callous but that's not the case. I just think its excessive.
