Small claims court

Could someone tell me in laymans terms step by step how i go about taking someone to the small claims court?
I have been to a solicitor and they have said the small claims procedure is something you do yourself,i need to take my mum to the small claims court to get her to give me back something that belongs to me,the solicitor told me i can do that in small claims court,i dont want money from her cause i know she has none,or will say that,i just want whats mine.So anyone done it and can talk me through it please??

I had a leaflet that the CAB gave me about this but I don't know what I have done with it.

You could either find out where the small claims is near you and ask them or go and see the CAB.

hi i had to take one of the parents i minded for to court to get money they owed me. i had to go to to the sm claims court to fill in a form and paid the money for them to process the claim. i think it was about £28. then they send a letter to you and one to the other person. then it's left for a while to see if they disagree with the claim. mine was disputed. it went to court and the judge adv that they had to pay x amount every week until it was paid. hth

www.hmcourts-service.govuk tells you how to make a claim.

The address and tel no of your local county court is in the phone book under Courts. or on that website.

The small claims court is for claims for £5000 or less or £1000 or less if for personal injury or housing disrepair.

Costs - where your claim is for money only and the amount is up to £300, will cost you £30 - up to £500, will cost you £50, up to £1000, will cost you £80 and so on.

If person doesn't pay, there are further fees if you want to chase them up.

Just remember even if you win your case the court does not guarantee you will be able to get the money you are owed.
