DH works/taxed abroad, affect on WTC & CB

Hi, my DH has recently started a new job in Germany and is employed & taxed there. His income is above £50,000
I am currently on maternity leave but intend to go back to work PT here in the UK and will likely earn around £20,000.
Am I eligible for tax credits and full child benefit or does DH foreign salary still get assessed as part of the household income? I might add I am interested in the legal rather than moral answer to this question....

No, his salary would still count.

If he is away for more than 8 weeks at a time you can probably make a single claim for tax credits. You can ALWAYS claim full child benefit, but he may have to repay some if his income is over £50k: this depends on his tax status in the UK (resident/ordinarily resident/domiciled). You could try talking to the Citizens Advice Bureau about this, otherwise you need an accountant really to talk through the options.
