Benefits (housing, income support ) after leaving work

Does anybody know if we cna claim benefits if my partner leaves his job to take his employers to a tribunal for constructive dismissal. I am currently working as a temp and have been kept on for another month (after xmas)....but if he leaves his job then i can no longer get to work so we have no form of income what so ever...

Possibly yes becuae you have child/ren.But i think there will be some kind of penalty because he has voluntarily given up work.Not sure though best to get to your local job centre or call benefits office to find out more.

I think you would have to get some income support and housing benefit because you have children. I'm not sure if your dp would be entitled to anythign though.

I would suggest that you seek specialist legal advice before your dp gives up his job. Constructive dismissal can be hard to prove to an employment tribunal and the benefits agency may choose to consider that he has given up his job. You may be entitled to some temporary benefits, but, if he loses his claim to the tribunal, the agency would seek to recover that money. It's very tricky so get some specialist advice first.

Thanks Freckle, but we have been seeking advice through ACAS and Cab for the past 4 months..(but our cab guy is away for a week in tribunals) and his solicitor has been ill but she is in court now this week too.

We know how hard it is, but dp has huge amounts of evidence..(letters, ekmails) has gone through their shambles of a grievance procedure and has been advised to walk whenever is best for him....(which it isn't financially iyswim)
