We think the insurance assessor got it wrong

But we don't know what to do.

Our tenants complained of damp type problems in the bathroom. We got a specialist out to have a look (damp specialist) just to be sure and he said there is a leak coming from the upstairs property. The tenants didn't believe it wasn't damp and therefore out property called out the Council - The Council agreed with the damp specialist and slapped a notice on the upstairs neighbour. We informed our insurance but they've said that it is due to the tenants not having the shower curtain inside the bath when in the shower! Unfortunately, we were not in attendance when the assessor was there - only the tenant.

We have a plumber going out to look as well at the start of the week but can we go back to the insurance assessor and tell him we think he got it wrong?

Yes, and provide written evidence from the council and the damp specialist.

I would also contact the insurance company direct (rather than the assessor who may just be sub contracted (?) by them and discuss with a claims manager.
